Refund policy
Quick note: same disclaimer as before — I'm not a lawyer, and alcohol retail has specific return exceptions under Lithuanian law, so it's worth a lawyer's review before publishing, especially the parts about withdrawal rights and defective goods.
Here's a Return and Refund Policy consistent with the Terms and Conditions we already built:
Return and Refund Policy
1. General Provisions
1.1. This Return and Refund Policy (hereinafter – the "Policy") applies to purchases made on gasparswines.com, operated by Gasparas, UAB (registered address: J. Savickio g. 4-7, Vilnius, Lithuania; email: info@gaspars.lt).
1.2. This Policy forms part of, and should be read together with, our Terms and Conditions.
2. Right of Withdrawal
2.1. In accordance with the Civil Code of the Republic of Lithuania and Directive 2011/83/EU, the Buyer has the right to withdraw from a distance purchase agreement within 14 calendar days from the date of delivery, without giving any reason.
2.2. To exercise this right, the Buyer must notify the Seller in writing by email to info@gaspars.lt, stating the order number and the goods to be returned.
2.3. The goods must be returned undamaged, in their original packaging, with labels intact, and not used or opened.
3. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to:
3.1. alcoholic beverages, once the order has been dispatched or delivered;
3.2. custom orders or goods produced to the Buyer's specifications;
3.3. food products, provided they are of appropriate quality and their best-before date has not expired;
3.4. goods which, due to their nature, cannot be returned or deteriorate rapidly;
3.5. gift vouchers and tickets, which are non-refundable and non-exchangeable;
3.6. other cases provided for by the legal acts of the Republic of Lithuania.
4. Defective or Damaged Goods
4.1. If the Buyer receives a product with a manufacturing defect (for example, cork taint in wine, a broken seal, or damage during transit), the Buyer must notify the Seller within 3 business days of delivery.
4.2. To report a defect, the Buyer should email info@gaspars.lt with the order number, a description of the issue, and photos of the product and packaging.
4.3. If the defect is confirmed by the Seller, the product will be replaced with the same or a similar product, or a refund will be issued, at the Buyer's choice.
4.4. The Seller is not responsible for damage caused by improper storage or handling after delivery.
5. Refund Process
5.1. Once a return or refund request is approved, the refund will be processed within 3 business days.
5.2. Refunds are made using the same payment method used for the original purchase, unless otherwise agreed with the Buyer.
5.3. If the Buyer refuses to accept delivery without a valid reason, the Buyer shall cover any delivery costs incurred, and this amount may be deducted from the refund.
6. Return Shipping Costs
6.1. If the return is due to a defect or an error by the Seller, the Seller covers the return shipping costs.
6.2. If the return is due to a change of mind (where legally permitted), the Buyer covers the return shipping costs.
7. How to Start a Return
7.1. Email info@gaspars.lt with your order number and reason for return.
7.2. Our team will respond with instructions on how to proceed, including the return address if applicable.
